						 <p>Problem is if FFII should follow &quot;inventive step&quot; just to untangle it - or use the UK/10cc sharp blade. This is two tests that should be separate in order to be useful and clear. I seem to remember the transformation test stretching back to Diamond v Diehr and possibly before.</p> <p>From Wikipedia (On Diehr):<br /> The court repeated its earlier holding that software as such is not eligible for patent protection. But it also held that a physical machine or process which makes use of a mathematical algorithm is different from an invention which claims the algorithm, as such, in the abstract. Thus, if the invention as a whole meets the requirements of patentability—that is, it involves &quot;transforming or reducing an article to a different state or thing&quot;—it is patent-eligible even if it includes a software component.</p> <p>(e.g. the rubber curing process as a whole.)</p> <p>The reversal of the patent rejection was affirmed. But the Court carefully avoided overruling Benson or Flook. It did criticize the analytic methodology of Flook, however, by challenging its use of analytic dissection, based on Neilson v. Harford. The Diehr Court said, without citation of any supporting authority, that under section 101 the invention had to be considered as a whole.[2]</p> <hr /> <p>Also from Wikipedia: (on Bilski)<br /> Not only did the patent-eligibility trilogy (Benson, Flook, and Diehr) support this test, the court explained, but so too did earlier Supreme Court precedents dating back well into the Nineteenth Century.</p> <p>I am aware that Wikipedia is not always a trustworthy source but it did confirm what I already thought from research a while ago now.</p> <p>The &quot;real world&quot; values in my opinion won't hold up to the &quot;form over substance&quot; requirement put forward by the Supreme Court in Flook. I doubt the Supreme Court will be taken in by such oversimplified logic coming from the now discredited Federal Appeals Circuit who were the authors of this mess in Alappat. We also note in the preamble a security unit, which is embodied in the second step of storing the system keys.
